The ADHD Burnout Program (“Program”) is provided to you by Bec Thompson trading as ADHD Vitality Coach (ABN 84490366702) (“JRSWM Pty Ltd”).
Please read these terms and conditions carefully. These terms and conditions form a contract between you and ADHD Vitality Coach. By accepting these terms and conditions or proceeding with the Program you acknowledge that you have read and understood these terms and conditions and agree to be bound by them.
(No Medical or psychological advice) You agree and acknowledge that:
a. the Program has not been written by doctors or psychologists and you will not receive any medical or psychological or other professional advice during the Program or any advice in relation to any medical or psychological treatment; and
b. the information and strategies provided as part of the Program are of a general nature only and may not be suitable for you or your family or your particular circumstances. You are responsible for assessing whether any of the tip, or strategy, method or technique provided by the Program is suitable for you or your family prior to implementing any tip, strategy, methods or technique you learn or access through the Program.
(Wellbeing) You are responsible for the wellbeing of yourself and while undertaking this Program. If in doubt, you should seek professional advice.
(No special skills) All opinions and strategies provided as part of the Program or on The ADHD Vitality Coach website are based solely on the experiences of The ADHD Vitality Coach founder as an individual with ADHD and ICF Accredited ADHD Coach and not on any medical practitioner skills.
(No guarantee of results) The Program contains tips and strategies that have been tested by and achieved results for The ADHD Vitality Coach founder, however there is no guarantee that you will achieve any particular result.
(External Content) From time to time, ADHD Vitality Coach may provide links to content or resources on other websites not operated by ADHD Vitality Coach. Such links are provided for informational purposes only and ADHD Vitality Coach does not warrant the accuracy or completeness of any information or content and will not be liable in any way in relation to the content provided on such third party websites.
(Program Materials) The Program materials are made available to you during the Program for your personal use only. You may not otherwise use, copy or distribute any of the Program materials. You may not use any of the Program materials for your financial gain or a commercial purpose. All Program materials remain the property of The ADHD Vitality Coach or its licensors.
(Access to Program Materials) The Program materials will be available to you for a total of 6 months after you begin the Program. After this time, you will no longer have access to the Program or the Program materials. You will not be entitled to a refund in the event that you do not complete the Program during the time period allowed. The ADHD Vitality Coach does not guarantee that your access to the Program materials or The ADHD Vitality Coach website will be uninterrupted or error free or free from viruses or malware. In the event of significant disruption or technical difficulties caused by The ADHD Vitality Coach or its infrastructure which prevent you from accessing or participating in the Program, ADHD Vitality Coach will consider giving you a full or partial refund, providing that you have promptly notified ADHD Vitality Coach of the problem, in any event no later than 30 days after the issue is experienced, and have allowed the ADHD Vitality Coach to fix the problem or resupply the Program. Under no circumstance will ADHD Vitality Coach be responsible for problems caused by you or your service providers.
(Your feedback) You grant ADHD Vitality Coach a revocable, worldwide royalty free licence to use, publish and distribute any feedback you provide in relation to the Program to promote and market the Program and you warrant that such use of your feedback will not breach the intellectual property rights of any third party.
(Privacy) You acknowledge ADHD Vitality Coach’s privacy policy as published on its website and agree that your personal information may be used in accordance with the policy. The Privacy policy may be changed by ADHD Vitality Coach from time to time ad changes will be posted to the ADHD Vitality Coach website.
(Limitation of Liability) To the extent permitted by law, ADHD Vitality Coach will not be liable to you for any loss or damage you sustain in connection with the Program, or for any consequential loss or special damages or for any claim or cause of action whatsoever (including for negligence) in connection with the Program. To the extent such liability cannot be excluded by law, such liability shall be limited to a refund of the Program fee.
(Consumer Law Rights) This contract does not exclude your applicable rights under Australian consumer law.
This agreement may only be varied or assigned by agreement of the parties in writing.
In the event that any part of this agreement is unenforceable, void, illegal or invalid, that part shall in the first instance be read down so as to be valid and enforceable, and if such reaching down not possible, it shall be severed from this agreement without affecting the validity or enforceability of any other part of this agreement.
This agreement is the entire agreement of the parties in relation to its subject matter.
This agreement shall be governed by the laws of the state of Queensland and the parties unconditionally surrender to the jurisdiction of the courts of the state of Queensland.
